THE five men facing charges following the terrorist activities in Georgetown in 2009, were freed of two yesterday. One of the allegations, that Colin Jones, Randy Mars, Jafar Simpson, David Watson and Basil Morgan had discharged a loaded firearm at a police officer, was dismissed by Magistrate Hazel Octive-Hamilton, who ruled there was not sufficient evidence for the accused to stand trial in the High Court.
It had been alleged that the accused fired the gun at policeman Karl Marks, on November 4, 2009, with intent to maim disfigure or cause him grievous bodily harm.
The Court found that Marks gave conflicting testimony and could not identify the shooters.
The other charge, of attempted murder, that was thrown out said the quintet, on November 9, 2009, fired at Clayton Westford with intent to commit murder.
Police Deputy Superintendent Fazil Karimbaksh, who was prosecuting, informed the court that he was discontinuing the case since the virtual complainant never came forward to testify.
However, the accused are still charged with, among other offences, setting fire to Richard Ishmael Secondary School and the Supreme Court buildings, for which they have been committed to stand High Court trials.
