Eleven-year-old charged with breaking and entering, stealing
AN eleven-year-old boy who ran away from his parents who live in the Interior yesterday appeared before Principal Magistrate Melissa Robertson-Ogle charged with breaking into his neighbour’s house and stealing a quantity of cash.
The Magistrate read the charge to the child as he stood beside his grandmother in court.
Particulars of the offence said on November 26 last at Parika, he broke and entered the dwelling house of Eldad Adams and stole $40,000 cash.
A not guilty plea was recorded by the Magistrate after the boy admitted to entering the house but stealing only $300.
The first form student said the man is his neighbour and he explained that he went through the back door of Adam’s house and stole the money off the table.
He explained that he escaped from his parents because he is often placed to kneel down on a grater and is subject to much beating.
He continued that he would occasionally be tied up before being beaten and he also claimed that he is tasked many chores.
The Magistrate urged him to make this offence the first and last one and released him into the custody of his grandmother, fixing the next hearing for December 4 at Leonora Magistrate’s Court.
Fishing vessel owner without adequate competency certificate charged
OWNER of a fishing vessel, Premdat Harrydatt, and his handyman, Rudolph Persaud, yesterday appeared before Principal Magistrate Melissa Robertson-Ogle charged in connection with not having the necessary requirements for operating the boat.
Persaud, 22, of Lot 279 Mon Repos, and Harrydatt, 48, of Lot 26 Mon Repos, East Coast Demerara, initially pleaded guilty to the offences but after being informed that they each carry a fine of $100,000, they later changed their pleas by advice from their lawyer, Mr. Adrian Thompson.
Particulars of the charge read to Persaud said on last November 27 in the Demerara River, he acted as the Master of a vessel (to wit a fishing boat and two 48 H.P Yamaha Engines) while he was not the holder of an Appropriate and Valid Local Certificate of Competency to do so.
The charge read to Harrydatt said on the same day at the same location, he permitted Rudolph Persaud to act as a Master of the said vessel while he was not the holder of a Certificate of Competency to do so.
Thompson asked the Magistrate to consider that the men depend on this vessel because it is their only means of income for the men who have their families to care for.
He said the Minister of Home Affairs is meeting with various fishermen today to discuss issues relating to these charges and also to address issues in connection with the recent robberies of various fishing boats, including the one belonging to his clients.
Thompson asked the Magistrate to wait and see the outcome of the meeting before pronouncing penalty since the Minister will make certain decisions and may even waive a few requirements.
But Police Corporal Sherwin Matthews, prosecuting, said that this meeting has nothing to do with these charges and noted that nothing would be changed unless it goes back to Parliament.
The Court released the defendants on $50,000 bail each and the case will be called again on December 13.
Man caught hiding in shop on robbery charge
SYLVESTER Major, allegedly caught hiding under the stairs in a shop that he robbed while being abandoned by an accomplice, yesterday appeared before Principal Magistrate Melissa Robertson-Ogle.
Major, 23, of Parika, East Bank Essequibo and Lot 31 John Alley, Christianburg, pleaded not guilty to the charge and was represented by attorney-at-law Mr. Glen Hanoman.
According to the particulars of the offence, on last November 27 at Parika, he broke into the store of Kenrick Persaud and stole $90,000 cash.
Hanoman pleaded with the Court to grant his client bail after noting that a number of his relatives were present in Court which gave proof of his good character.
The lawyer claimed that when this business place was robbed, there was a shooting which caused people to run and scatter.
As a result, Hanoman said that Major then hid in the shop because of fear of coming into contact with the bullets.
But Police Corporal Sherwin Matthews, prosecuting, said Major was in the shop with an accomplice, Imran Phillips, who made good his escape with the cash.
Matthews argued that the submissions made by Hanoman made no sense since he could not understand how someone hiding from a shoot out would end up in someone’s shop under the stairs.
Major was remanded to prison until December 4 at Leonora Magistrate’s Court.
Duo on separate charges of threatening behaviour, unlawful wounding
TWO men who shared a relationship with a woman appeared before Magistrate Geeta Chandan on separate charges of threatening behavior, unlawful assault and unlawful wounding.
Police said Latchman Deonarine called Eric wounded Narvindra Seegobin , following a visit to the latter’s home.
It is alleged that on November 12 last , Deonarine went to the house where the mother of his child lived, and sought to have her dress a wound, but Seegobin , who was having lunch in a hammock, objected to the act being done and ordered the intruder to leave his premises. However, Deonarine became annoyed and allegedly dealt the unarmed man a chop on his right hand .The injury was inflicted with a cutlass which was concealed in his waist.
Seegobin, 33, a seaman of Sheet Anchor , East Canje was granted bail in the sum of $10,000 after he denied the charge of threatening behavior, while Deonarine, 46, was allowed $40,000 bail on the wounding allegation. The men are expected return to court on December 7, for report.
Lyte sentenced to one year for larceny
CHRISTIAN Lyte, 19, no address given, was sentenced to one year imprisonment on a simple larceny charge.
The youth appeared before Principal Magistrate Krishendat , in the New Amsterdam Court ,and confessed to stealing 65 DVD’S belonging to Edris Ward.
According to the police, the convict, who is known to the complainant, went to Ward’s residence at Harkman’s Lane on November 15, last and removed the articles while being a guest there.
The matter was reported and the charge was laid at Central Police Station.
Prior to sentencing, the youth said he was sorry, but he committed the offence because the virtual complainant had owed him.
Saunders charged for threatening language refused bail
CLIFFORD Saunders, 33, of Lot 92 Amsville Housing Scheme, was refused bail on a threatening language charge.
Magistrate Chandra Sohan made the decision to keep the defendant behind bars following a revelation by the complainant Michele Edwards.
The teacher informed the court that there are other matters of bigamy and wounding currently being heard before another Magistrate in Georgetown.
According to the woman, the defendant married her on July 2004, knowing that he is married.
She said as a result he was charged. The alleged victim said that she is subjected to the defendant’s physical abuse and is fearful for her life. Police said following the charges which are currently being heard in the Georgetown Magisterial District, the defendant on August 26, last threatened Edwards. She said he had threatened to kill her.
The case is fixed for hearing on December 14.
Repeated offender sentenced to 18 months
MAGISTRATE Chandra Sohan imposed an 18-month sentence on a repeated offender charged with simple larceny.
Police Inspector Fazil Karimbaskh, prosecuting informed the court that on Thursday the victims left the articles mentioned in their respective bags in a parked mini-bus at Strand and Trinity Street, in New Amsterdam.
Noel Carter, who confessed to the theft, went into the bus and removed a quantity of clothing, perfumes and other articles valued $33,000. The bags belonged to Carlotta Hinds and Sonia Griffith respectively.
The convict pleaded for leniency, noting that he did not waste the court’s time. As a consequence the Magistrate imposed two nine-month sentences which will run consecutively.
Arms and ammunition convict receives two years, fined $60,000
AN arms and ammunition convict was sentenced to two years imprisonment and fined $60,000, after he changed his plea to guilty before Magistrate Geeta Chandan at the Fort Wellington Court on Thursday.
Lancelot Bailey of Ithaca Village, West Bank Berbice, was arrested following a raid at his home on May 14, last.
Police Sergeant Satrohan Dayaram , prosecuting, said ranks from Georgetown, acting on information went to Bailey’s house, where a .32 magnum pistol with eleven matching rounds of ammunition was unearthed in his bedroom. He was arrested and taken to Eve Leary where charges were laid.
Bailey made his first court appearance before Magistrate Gordon Gilhuys, in the Georgetown Magisterial District who transferred the case to the Blairmont Court for hearing.
Auto sales owner, mechanic on simple larceny charge
OWNER of Jumbo Jet Auto Sales also known as M.N Auto Sales, Nazrudeen Mohamed, yesterday appeared together with his mechanic, Rajesh Singh, before Principal Magistrate Melissa Robertson-Ogle charged with simple larceny.
Particulars of the joint charge said on November 18, 2006 at Soesdyke, East Bank Demerara, they stole motor lorry GGG 5626 valued $3,800,000, property of Baldeo Singh.
Both defendants pleaded not guilty and were represented by Attorney-at-law Mr. Anil Nandlall.
Nandlall in a bail application said that Baldeo was indebted to his client, Mohamed, in the sum of 13 million dollars and there was a promissory note to that effect.
Nandlall said the parties arrived at an agreement whereby Mohamed would accept a return of the Lorries at an agreed price so that the man could settle his debts.
The lawyer added that while pursuing this arrangement, Mohamed had Singh check the vehicles with the consent and permission of Baldeo.
Nandlall said Baldeo is still indebted in the sum of $2.3M which was the balance outstanding from the $13M and as such, he has instituted legal proceedings in the Commercial Court to recover this amount of money.
He also questioned why his clients are being charged only now since those vehicles were returned since November 2006.
Mohamed and Singh were each released on $85,000 bail. The case will be called again on December 14.
Rudder in court again
TRAVIS Rudder, charged recently with the murder of 14-year-old Donnis King, yesterday appeared once again before Magistrate Hazel Octave-Hamilton charged with unlawful possession of a gun and ammunition.
Rudder, 27, of Lot 5 Public Road, McDoom, East Bank Demerara, denied both charges of which said on last November 22, without lawful authority, he had in possession one .380 ‘Bryce’ revolver and three .380 ammunition, without being the holder of a firearm licence in force at the time.
Rudder will remain a prisoner until February 11, when these matters will be called again.
Before he was escorted down the chute, he told the Magistrate that he is being victimised by the Police.
Earlier this week, Rudder appeared in this same Court together with Sivon Warner, 25, of Tucville, Georgetown, jointly charged with the murder of Ivor Cordis.
Cordis, 47, of Lot 44 Norton Street, Bagotstown, an employee of Demerara Oxygen Company Limited (DOCOL), was robbed of cash and then shot while he was delivering cooking gas at Stevedore Housing Scheme in South Georgetown on the night of November 15.
This matter was fixed for December 17.
Rudder was however charged alone with the murder of King, a former student of the David Rose Community High School in Georgetown who was allegedly shot by her boyfriend (Rudder) and subsequently died in the Intensive Care Unit of the Georgetown Hospital.
King was allegedly forced to stand against a wall, with a hand to her throat, and shot at point blank range at her family’s apartment at Lot 41 Norton Street, Bagotstown.
This matter was postponed to December 10 at Providence Court.
Rudder was also charged with robbery under arms and attempted murder and was not required to plead to any of these charges when he appeared on this occasion.
It is alleged that on last May 15, armed with a gun, he robbed Nicola Barclay of an ‘L6’ Motorola cellular phone and $17,000 cash, together worth $49,000.
On last November 19, Rudder is accused of discharging a loaded forearm at Tony Williams with intent to commit murder.
Rudder will return to Court on January 9 for the gunpoint robbery and will continue the attempted murder case on January 22.
Police on last March 27 had issued a wanted bulletin for Rudder but the brown complexion, medium built, unemployed young man has only been recently arrested.
